Texas House Passes Two Landmark Measures for Parental Rights

AUSTIN, TX — In a major victory for Texas families, the Texas Legislature has given initial approval to two key measures designed to give Texas families the strongest parental rights protections in the country. 

Parental Rights Constitutional Amendment – SJR 34
The Parental Rights Constitutional Amendment has passed the Texas House and the Texas Senate, marking a major step toward securing lasting protections for families. This historic constitutional amendment now requires one final procedural vote in the Senate before heading to the ballot for a statewide vote in November. Authored by Senator Hughes and Representative Frank, the amendment would enshrine in the Texas Constitution the fundamental right of parents to raise their children–the first state constitutional amendment of its kind in the country. This amendment offers a stable, long-term safeguard for Texas families.

 

Parental Presumption Bill – SB 2052
SB 2052, the Parental Presumption Bill, has passed the Texas House on second reading with near-unanimous support. After one final procedural vote in the House tomorrow, the bill will head to the Governor’s desk to be signed into law. This bill reinforces the constitutional principle that fit parents—not the state—are best positioned to make decisions for their children’s well-being. The bill requires courts to presume that the actions of a parent are what is in that child’s best interests. This presumption cannot be overcome except by clear evidence that an intervention by the court is necessary to prevent significant harm to the child. 

Both of these victories come in response to growing calls for reform and renewed commitment to family freedom in Texas.

“These are not just procedural wins—they are a turning point,” said Jeremy Newman, Vice President at the Family Freedom Project. “For years, Texas parents have watched their rights eroded by vague laws and shifting judicial interpretations. Today, the Legislature took bold action to change that. These measures send a clear message: in Texas, parents—not the government—have the primary right and responsibility to raise their children. This is a historic day for family freedom.”
